O espaço geográfico é uma categoria da ciência geográfica que possibilita uma acentuada e complexa possibilidade de refletir a coletividade social, sendo que neste desafio são trazidas à tona inúmeras perspectivas de análises da relação homem-natureza. Dessa feita, o presente estudo elabora uma breve discussão acerca do espaço geográfico enquanto uma ferramenta de análise das relações sociais, além de evidenciar a sua centralidade no interior da Geografia. Ao longo do estudo estão colocadas algumas concepções teóricas desta categoria geográfica, com destaque (...) para os entendimentos elaborados pela Geografia Crítica, uma reflexão que propõem a necessidade de se politizar os sujeitos por intermédio do ensino, com destaque para os conteúdos geográficos ensinados por seus respectivos professores desde os primeiros anos do ensino fundamental. A busca aqui foi a de confirmar a capacidade que a Geografia possui em se utilizar do próprio espaço geográfico na qual os alunos estão inseridos enquanto materialidade para uma concepção própria de mundo, sendo que através desta conquista, se permite compreender e pensar a construção de uma sociedade pela e para a própria coletividade envolvida. É esta a grande questão discorrida no presente ensaio, pensar uma proposta de ensino na geografia que politize os sujeitos, permitindo assim a formação de sujeitos ativos e cientes do seu papel no mundo. The Bayesian maxim for rational learning could be described as conservative change from one probabilistic belief or credence function to another in response to newinformation. Roughly: ‘Hold fixed any credences that are not directly affected by the learning experience.’ This is precisely articulated for the case when we learn that some proposition that we had previously entertained is indeed true (the rule of conditionalisation). But can this conservative-change maxim be extended to revising one’s credences in response to entertaining propositions or (...) concepts of which one was previously unaware? The economists Karni and Vierø (2013, 2015) make a proposal in this spirit. Philosophers have adopted effectively the same rule: revision in response to growing awareness should not affect the relative probabilities of propositions in one’s ‘old’ epistemic state. The rule is compelling, but only under the assumptions that its advocates introduce. It is not a general requirement of rationality, or so we argue. We provide informal counterexamples. And we show that, when awareness grows, the boundary between one’s ‘old’ and ‘new’ epistemic commitments is blurred. Accordingly, there is no general notion of conservative change in this setting. The problem of the ontological limit of Artificial Intelligence and transhumanism in contrast with the ontology of Homo sapiens is discussed. Beyond the so-called exogenous or endogenous integration, the scenario of a technological singularity seems to materialize in entities that synthesize biology and technology, for example, by means of a download or transbiomorphosis that translates the neural networks of our mind into the memory of a computer. This is a hybridization that warns us about the advent of new species that (...) could leave Homo sapiens behind. If the human/machine synthesis is the limit desired by the transhumanist program, this limit seems to have crossed, in turn, the very ontological limit of the human, on which science, philosophy and religion had so far more or less agreed –each presenting their own cards. I argue that different approaches to environmental ethics can be traced to different ways of thinking about value. In particular, it can be traced to different understandings of what kinds of things are the primary bearers of value and different views about how we should respond to that value. These different ways of thinking about value are thought to have their origins in consequentialism and Kantianism, respectively. Background: Clinical and experimental findings have suggested that insomnia is associated with altered emotion processing, such as facial emotion recognition and impairments in executive functions. However, the results still appear non-consensual and have recently been presented by a few number of studies. Accordingly, the aim of the present study was to investigate whether patients with Insomnia disorder will present alterations in recognition of facial emotions and that such alterations will be related to Executive Functions and that Insomnia Disorder patients will (...) exhibit a lower Executive Functions performance when compared to normal controls individuals. Method: A total of 11 individuals diagnosed with insomnia disorder and 15 control participants took part in the present cross-sectional study. They completed questionnaires covering socio-demographic data, a sleep and mood evaluation, and a cognitive assessment. Moreover, they underwent a computerized Facial Emotional Recognition test, consisting of facial emotion labeling and facial emotion matching. Results: Individuals with insomnia presented a lower recognition of facial expressions of fear and sadness in comparison to control volunteers. Perceptual Organization Index was found to be statistically significant lower in the insomnia group compared to the control group. There was a statistically significant association between facial recognition emotional and cognitive processes of in executive functions performance, especially in processes related to the inhibitory control, planning capacity, problem solving and cognitive flexibility in insomnia group. Conclusions: Insomnia disorder impairs the facial emotion recognition of the fear and sadness. Insomniacs with impairment in the facial emotion recognition had impaired performance of executive functions. There is a negative impact on processes related to cognitive-emotional capacity than on processes related to social-emotional recognition. The United Nations’ increasing involvement in global sustainability culminated in 2015 with the release of the 2030 Agenda. This agenda puts businesses in the spotlight, and their innovation and stakeholder partnering activities are portrayed as essential strategies for achieving an ambitious set of 17 Sustainable Development Goals. In this study, we identify six distinct dynamic stakeholder engagement strategies—resilient specialists, opportunity explorers, uncommitted diversifiers, rainbow warriors, rainbow washers, and progressive learners—and distinguish two approaches to innovate, depending on the range of SDG (...) targets aimed to achieve simultaneously. On the one hand, for firms that take a narrow approach intended to achieve a reduced set of SDG targets, we predict that successful dynamic stakeholder engagement strategies are those that end up with an intensive collaboration with a reduced number of stakeholder groups. On the other hand, for firms adopting a broad innovation approach to satisfy a wide set of SDG targets, we predict that successful dynamic stakeholder engagement strategies are those that end up interacting with a wide number of stakeholder groups. Longitudinal analysis of more than 3900 Spanish firms supports our predictions and suggests clear implications for responsible innovation research and the advancement of sustainable development through collaboration. This article defends an account of collective hope that arises through solidarity in the pursuit of justice. I begin by reviewing recent literature on the nature of hope. I then explore the relationship between hope and solidarity to demonstrate the ways in which solidarity can give rise to hope. I suggest that the hope born of solidarity is collective when it is shared by at least some others, when it is caused or strengthened by activity in a collective action setting, (...) and when the reciprocal hopeful expressions of individual group members result in an emotional atmosphere of hope that extends across the group. In the context of social movements, collective hope emerges alongside the collective intentions and actions of the solidarity group; namely, in the pursuit of a form of social justice that inspires the movement. I then suggest that the object of collective hope born of solidarity is the guiding ideal of justice and reflect on what it might mean to hope well for justice. (shrink)

Now in an expanded 25th-anniversary edition, Katie's Canon still packs firepower.

This paper traces the history of remoteness in contract law, namely the legal formants (in Rodolfo Sacco’s terms) constraining the availability of contract damages in various legal systems. Our journey takes us through different times, continents and cultures, from the eighteenth century to the twenty–first century, across the law of France, United States, England and Wales, India and Australia, among other jurisdictions. While it might seem that civilian and common law traditions have very different morphological legal forms, once a closer (...) historical, cultural, and anthropological gaze is turned upon the legal formants involved, it can be seen that remoteness discloses a shared concern which may be common to many human societies and cultures. In other words, as a matter of social experience, humans who enter into transactions generally realise that it is impossible to know the future, or to know what all outcomes of the transaction will be. Consequently, it is recognised that it would be unfair and unjust to hold a defendant liable for all outcomes, and as our journey will show, legal systems seek guidance from other legal systems in their efforts to deal with this problem. Soren Kierkegaard's Works of Love, a series of deliberations on the commandment to love one's neighbor, has often been condemned by critics. Here, Ferreira seeks to rehabilitate Works of Love as one of Kierkegaard's most important works. He shows that Kierkegaard's deliberations on love are highly relevant to some important themes in contemporary ethics, including impartiality, duty, equality, mutuality, reciprocity, self-love, sympathy, and sacrifice. Ferreira also argues that Works of Love bears on issues peculiar to a religious ethic, (...) such as the role of God as "middle term," and the possibility of preserving the aesthetic dimensions of love in a religious ethic of relation. While the fundamental laws of physics are time-reversal invariant, most macroscopic processes are irreversible. Given that the fundamental laws are taken to underpin all other processes, how can the fundamental time-symmetry be reconciled with the asymmetry manifest elsewhere? In statistical mechanics, progress can be made with this question. What I dub the ‘Zwanzig–Zeh–Wallace framework’ can be used to construct the irreversible equations of SM from the underlying microdynamics. Yet this framework uses coarse-graining, a procedure that has faced much criticism. I (...) focus on two objections in the literature: claims that coarse-graining makes time-asymmetry ‘illusory’ and ‘anthropocentric’. I argue that these objections arise from an unsatisfactory justification of coarse-graining prevalent in the literature, rather than from coarse-graining itself. This justification relies on the idea of measurement imprecision. By considering the role that abstraction and autonomy play, I provide an alternative justification and offer replies to the illusory and anthropocentric objections. The ecosystem services argument is a highly publicised instrumental argument for protecting biodiversity. I develop a new objection to this argument based on the lack of a causal connection from global species losses to local ecosystem changes. I survey some alternative formulations of services arguments, including ones incorporating option value or a precautionary principle, and show that they do not fare much better than the standard version. I conclude that environmental thinkers should rely less on ecosystem services as a means (...) to defend biodiversity, and that attention should be focused on additional types of value which might be attributed to global biodiversity. This article is about the special, subjective concepts we apply to experience, called “phenomenal concepts”. They are of special interest in a number of ways. First, they refer to phenomenal experiences, and the qualitative character of those experiences whose metaphysical status is hotly debated. Conscious experience strike many philosophers as philosophically problematic and difficult to accommodate within a physicalistic metaphysics. Second, PCs are widely thought to be special and unique among concepts. The sense that there is something special about PCs (...) is very closely tied up with features of the epistemic access they afford to qualia. When we deploy phenomenal concepts introspectively to some phenomenally conscious experience as it occurs, we are said to be acquainted with our own conscious experiences. Accounts of PCs either have to explain the acquaintance relation, or acquaintance with our phenomenal experiences has to be denied. PCs have received much attention in recent philosophy of mind mainly because they figure in arguments for dualism and in physicalist responses to these arguments. The main topic of this paper is to explore different accounts of phenomenal concepts and their role in recent debates over the metaphysical status of phenomenal consciousness. (shrink)

What is the role of Hesiod's poetry in the beginnings of Greek philosophy? This book explores the question by going beyond the traditional responses that stress either continuities or discontinuities between myth and philosophy. Instead, this volume attempts a reflexive or response-oriented approach, that highlights the active re-appropriation and renewal of Hesiodic thought by the Presocratic philosophers. Its fifteen contributions offer large scale comparisons, historiographical considerations, thematic and generic approaches, and detailed case studies.

In this paper we describe an approach to practical reasoning, reasoning about what it is best for a particular agent to do in a given situation, based on presumptive justifications of action through the instantiation of an argument scheme, which is then subject to examination through a series of critical questions. We identify three particular aspects of practical reasoning which distinguish it from theoretical reasoning. We next provide an argument scheme and an associated set of critical questions which is able (...) to capture these features. In order that both the argument scheme and the critical questions can be given precise interpretations we use the semantic structure of an Action-Based Alternating Transition System as the basis for their definition. We then work through a detailed example to show how this approach to practical reasoning can be applied to a problem solving situation, and briefly describe some other previous applications of the general approach. In a second example we relate our account to the social laws paradigm for co-ordinating multi-agent systems. The contribution of the paper is to provide firm foundations for an approach to practical reasoning based on presumptive argument in terms of a well-known model for representing the effects of actions of a group of agents. In this paper we describe the impact that Walton’s conception of argumentation schemes had on AI and Law research. We will discuss developments in argumentation in AI and Law before Walton’s schemes became known in that community, and the issues that were current in that work. We will then show how Walton’s schemes provided a means of addressing all of those issues, and so supplied a unifying perspective from which to view argumentation in AI and Law.

Internet protocol development is a social process, and resulting protocols are shaped by their developers’ politics and values. This article argues that the work of protocol development poses barriers to developers’ reflection upon values and politics in protocol design. A participant observation of a team developing internet protocols revealed that difficulties defining the stakeholders in an infrastructure and tensions between local and global viewpoints both complicated values reflection. Further, Internet architects tended to equate a core value of interoperability with values (...) neutrality. The article describes how particular work practices within infrastructure development overcame these challenges by engaging developers in praxis: situated, lived experience of the social nature of technology. The search for the statistical mechanical underpinning of thermodynamic irreversibility has so far focussed on the spontaneous approach to equilibrium. But this is the search for the underpinning of what Brown and Uffink have dubbed the ‘minus first law’ of thermodynamics. In contrast, the second law tells us that certain interventions on equilibrium states render the initial state ‘irrecoverable’. In this article, I discuss the unusual nature of processes in thermodynamics, and the type of irreversibility that the second law embodies. (...) I then search for the microscopic underpinning or statistical mechanical ‘reductive basis’ of the second law of thermodynamics by taking a functionalist strategy. First, I outline the functional role of the thermodynamic entropy: for a thermally isolated system, the thermodynamic entropy is constant in quasi-static processes, but increasing in non-quasi-static processes. I then search for the statistical mechanical quantity that plays this role—rather than the role of the traditional ‘holy grail’ as described by Callender. I argue that in statistical mechanics, the Gibbs entropy plays this role. (shrink)

The increasing use of digital technologies in judicial and arbitration proceedings increases the usage of digital evidence by the parties, which brings the necessity of creating patterns for adjudicators to admit and assess this new type of evidence. This paper generally addresses digital evidence focusing on the second moment in international arbitration proceedings. It also narrows the topic to hacked and leaked evidence and its admissibility in international arbitration. The literature review showed a significant amount of research devoted to the (...) evidence in arbitration. Some considered electronic evidence within one jurisdiction; others focused on certain forms of digital evidence such as electronic signatures. Papers on digital evidence in international arbitration approach arbitration rules for digital evidence but skip admissibility issues. No systemic and complex works research digital evidence in arbitration, explicitly focusing on the admissibility of hacked and leaked digital evidence from a comparative perspective. Also, no research deals with enforcing international arbitration awards relying on illegally obtained digital evidence. In these cases, there could be a possible violation of domestic public policy under the New York Convention terms (art. V, 2, b). That is why the paper aims to offer the concept of digital evidence in international arbitration, including hacked and leaked evidence, criteria of its admissibility and relevance, and design the arbitration guidelines for assessing hacked and leaked evidence. Comparative legal analysis of the international arbitration rules and national procedure law allowed us to compare the regulatory approaches to the definition of digital evidence and its admissibility worldwide. The method of legal modeling allowed designing model guidelines for arbitral tribunals to evaluate the admissibility and relevance of digital evidence, including hacked and leaked evidence. Moreover, the case study method allowed us to analyze jurisprudence and define criteria for admission of hacked and leaked evidence. We conclude that the admissibility of hacked and leaked evidence depends solely on the arbitrator’s broad discretion to assess the evidence. Nevertheless, thorough evidence analysis and a well-reasoned award are always mandatory. (shrink)

In this paper we consider persuasion in the context of practical reasoning, and discuss the problems associated with construing reasoning about actions in a manner similar to reasoning about beliefs. We propose a perspective on practical reasoning as presumptive justification of a course of action, along with critical questions of this justification, building on the account of Walton. From this perspective, we articulate an interaction protocol, which we call PARMA, for dialogues over proposed actions based on this theory. We outline (...) an axiomatic semantics for the PARMA Protocol, and discuss two implementations which use this protocol to mediate a discussion between humans. We then show how our proposal can be made computational within the framework of agents based on the Belief-Desire-Intention model, and illustrate this proposal with an example debate within a multi agent system. En relación a esta conjetura, que por lo visto implica una cierta superación de la idea de obra, se (...) discute, por un lado, la conexión entre arte e inteligencia artificial y, por otro, las implicancias de la Everyday Aesthetics sobre el concepto de experiencia. El artículo pretende desmontar una vieja contienda habida en la tercera Crítica entre una estética y una filosofía del arte. Tal contienda mostraría a la de Kant como una estética en conflicto. Cual Jano bifronte, el filósofo de Königsberg presentará en la última Crítica una Crítica de la facultad de juzgar estética que va y viene entre una estética filosófica y una metafísica del arte, y que terminará convirtiéndose en una propedéutica para las filosofías del arte del Romanticismo. A partir (...) de la crítica de Derrida a lo colosal kantiano —comentario que permitiría conjeturar la presencia en la primera parte de la tercera Crítica de un olvidado arte sublime—, se plantea como hipótesis la posibilidad de una inacabada y obscura arquitectónica de la Crítica de la facultad de juzgar estética, donde la condición bastarda de lo sublime evidenciaría una cuestión no deducida trascendentalmente, pero sí experimentada por nuestras facultades del conocer, esto es, una conmoción suprasensible determinada por una suerte de principio de contra-finalidad. De este modo, el problema de lo sublime, cuya expresión de lo colosal está lejos de calificar como un caso del mundo del arte, revelaría al Kant de la tercera Crítica preso en el conflicto aparentemente irresoluble entre razón y sentimiento. É bem conhecida a oposição estabelecida por Kant entre experiência possível e dialética, na medida em que esta última é caracterizada como a “lógica da ilusão”. Ao mesmo tempo, o modo de pensar metafísico, que ocorre dialeticamente, em sentido kantiano, é uma tendência inevitável da razão, expressa na exigência formal de completude das categorias. Como o pensar, enquanto exercício livre da razão, é em si mesmo mais amplo do que a atividade de conhecer, própria do entendimento, o pensar contém o (...) conhecimento, embora este se qualifique pelas regras e pelos limites determinantes da objetividade. A pergunta que tentaremos formular é se essa relação continente-conteúdo não poderia configurar também uma dependência da experiência em relação ao raciocínio dialético, que estaria de algum modo indicada na função reguladora das idéias da razão. Nesse caso, a oposição formal entre conhecer e pensar seria inseparável da inclusão estrutural (dependência) da experiência no âmbito da razão. Na raiz do problema estaria talvez a tensão (dialética) entre a aspiração subjetiva de totalidade e as exigências objetivas de limitação e segmentação da experiência e a forma da experiência teria de ser finalmente concebida a partir de um fundo de inteligibilidade problemática. Dialectics and experienceThe separation of possible experience as objective knowledge and dialetics as a non-objective or non-theoretical knowledge is one of the most important aspects of kantian critical philosophy. But Kant also says that the activity of reason, as a pure thinking, has more amplitude than understanding knowledge. So we could say that theoric knowledge would depend on rational ( and non-theoretical) knowledge, as something contained in it. If we accept that, the consequence would be a relation of dependence between the form of objective knowledge and the background of a problematic – even doubtful – inteligible knowledge. (shrink)

I develop an account of ecological role functions—the functions of species within ecosystems—which is informed by alternative regime phenomena in ecology. My account is a causal-role theory which includes a counterfactual sensitivity condition. The account tracks and explains a distinction ecologists make between functions and various activities which are not functions. My counterfactual sensitivity condition resolves the liberality problem often attributed to causal-role theories of function, while also illuminating the explanatory centrality of role functions within ecology.

This paper addresses the stalemate on the question whether biodiversity has intrinsic value. I distinguish between a “weak” conception and two “strong” conceptions of intrinsic value in the environmental ethics literature. The strong conceptions of intrinsic value are connected, respectively, to moral standing and to a strongly objectivist account of value. Neither of these forms of value likely applies to biodiversity. However, the weak conception of intrinsic value is neutral about both moral standing and the nature of value and plausibly (...) applies to biodiversity. In addition, weak intrinsic value avoids common objections to the claim that biodiversity is intrinsically valuable. I develop a cumulative argument showing that environmentalists should presume that biodiversity has intrinsic value in the weak sense. (shrink)

In what sense are the special sciences autonomous of fundamental physics? Autonomy is an enduring theme in discussions of the relationship between the special sciences and fundamental physics or, more generally, between higher and lower-level facts. Discussion of ‘autonomy’ often fails to recognise that autonomy admits of degrees; consequently, autonomy is either taken to require full independence, or risk relegation to mere apparent autonomy. In addition, the definition of autonomy used by Fodor, the most famous proponent of the autonomy of (...) the special sciences, has been robustly criticised by Loewer. In this paper I develop a new account of autonomy following Woodward which I dub ‘generalised autonomy’ since it unifies dynamical, causal and nomic autonomy. Autonomy, on this account, can be partial: some lower-level details matter while others do not. To summarise: whilst the detailed lower level is unconditionally relevant, conditionalising on the higher-level facts renders some lower-level details irrelevant. The macrodependencies that the higher-level facts enter into — be they dynamical, causal or nomic — screen off the underlying microdetails. This account helps resolve an explanatory puzzle: if the lower-level facts in some way underpin the higher-level facts, why don’t the lower-level details matter more for the day-to-day practice of the special sciences? The answer will be: the facts uncovered by the special sciences are autonomous in my sense, and so practitioners of these special sciences need not study more fundamental sciences, since these underlying facts are genuinely irrelevant. There is growing consensus that teaching computer ethics is important, but there is little consensus on how to do so. One unmet challenge is increasing the capacity of computing students to make decisions about the ethical challenges embedded in their technical work. This paper reports on the design, testing, and evaluation of an educational simulation to meet this challenge. The privacy by design simulation enables more relevant and effective computer ethics education by letting students experience and make decisions about common (...) ethical challenges encountered in real-world work environments. This paper describes the process of incorporating empirical observations of ethical questions in computing into an online simulation and an in-person board game. We employed theValues at Playframework to transform empirical observations of design into a playable educational experience. First, we conducted qualitative research to discover when and how values levers—practices that encourage values discussions during technology development—occur during the design of new mobile applications. We then translated these findings into gameplay elements, including the goals, roles, and elements of surprise incorporated into a simulation. We ran the online simulation in five undergraduate computer and information science classes. Based on this experience, we created a more accessible board game, which we tested in two undergraduate classes and two professional workshops. We evaluated the effectiveness of both the online simulation and the board game using two methods: a pre/post-test of moral sensitivity based on the Defining Issues Test, and a questionnaire evaluating student experience. We found that converting real-world ethical challenges into a playable simulation increased student’s reported interest in ethical issues in technology, and that students identified the role-playing activity as relevant to their technical coursework. This demonstrates that roleplaying can emphasize ethical decision-making as a relevant component of technical work. (shrink)
